TERMS AND CONDITIONS FOR STUDENTS



This Agreement is a public offer (offer) for individuals, legal entities and individual entrepreneurs. By accepting this Agreement, you understand and agree to all the conditions set forth therein.

Acceptance of this Agreement means that you perform registration actions on the site http://mariinskayaschool.com in the form of filling out all the forms required by the Site and verifying (confirming) registration by clicking on the link sent to the email address you specified.

Please do not accept this Agreement if you do not agree to the following terms and conditions:

- The service is a technical solution for organizing access to its content for Users who have passed the registration procedure.
- The user is responsible for the inconsistency of the information provided by THEM during registration and is aware of the full risk of adverse consequences associated with its incorrect indication. The Service does not verify the accuracy of the data provided by the User, except in cases when verification of such information is necessary for the Service to fulfill its obligations to the User.
- The User is solely responsible for all intellectual property objects placed by him on the Service independently (photos, pictures, drawings, articles, logos, other objects that, by virtue of the current legislation).
- The Service has the right to send advertising and informational messages to Users registered on the Service (send messages to User accounts, to their mobile phones specified as contact, as well as their email addresses) about the work of the Service, about its promotions and other opportunities, press releases, reviews and other information notifications directly or indirectly related to the operation of the Service. By accepting this Agreement, the User agrees to receive the mailing list specified in this paragraph.
- The User does not have any right to copy any information posted on the Service that is available to him both before and after the registration procedure. The User is prohibited from copying the Works and Materials of other Users and performing any other action that directly or indirectly infringes on the rights and interests of the Administration of the Service, the Teacher and third parties. The Administration of the Service, upon detection of violations specified in this paragraph on the part of the User, has the right to block the User's Account, and depending on the violation, file a claim with the User or apply to a judicial authority to protect their rights and interests.
- By accepting this Agreement, the User gives full unconditional consent to the use of Materials by the Service: drawings, sketches, plans, sketches, photographs and other objects, including User Works, as defined in the section "Terms and Definitions", which are uploaded by the User to the Service and which are used by the Service on the terms established by this Agreement. Simultaneously with the acceptance, the User provides a guarantee that the placement of Materials and their subsequent use does not violate the rights and interests of third parties.

1. Terms and definitions


1.1. The project is an online school of PAINTING AND DRAWING MARIINSKAYA SCHOOL, aimed at maintaining interest in fine art, familiarization with its basics and directions, as well as training in various areas of painting and fine art techniques.

1.2. An audiovisual work is a file with a recording of master classes in drawing techniques.

1.3. The course consists of several thematically combined educational audiovisual works with a recording of the drawing technique. In the context of this Agreement, the term "Course" in the singular will also have the meaning of the plural, depending on how many Courses (one or more) are actually purchased by the User within the framework of the Project.

1.4. Account — the User's personal space on the Service, which is formed as a result of the User's registration on the site http://mariinskayaschool.com

1.5. Service — a software and interactive complex located at http://mariinskayaschool.com on the Internet, accessible to Users on a paid and free basis, the main focus of which is to provide Users with access to educational Audiovisual works.

1.6. User — an individual, a user of the global Internet.

1.7. Service Administration — individuals who directly or indirectly manage and control the activities of the Service.

1.8. The actual cost of the Project services is the amount of money indicated on the website http://mariinskayaschool.com , which is relevant from the date of its actual publication on the Service until the Service Administration publishes the new cost of services. It is considered that the cost of services that is available to any User at the link specified in this paragraph is the Actual cost.

1.9. Teacher — an individual participating in the Project, acting as a person teaching Users the basics of fine art and drawing techniques.

1.10. Affiliate program — goods, works, services of third parties available to the User on certain preferential terms, in case of registration of the User on the Service with the subsequent purchase of the Course.

1.11. Free access — User access to the Course (Courses) without payment. The administration of the Service independently determines the content of Free Access, and the User has no right to make any claims to the Service regarding the content of the Course available on a Free basis.

1.12. Paid access — access to the Course provided after its payment by the User.

1.13. Works — paintings drawn directly by the User before, during and/or after the User receives access to the Course.

1.14. Materials — drawings, sketches, plans, sketches, photographs, sketches, sketches and other objects that the User has the right to place on the Service.

1.15. Public data — personal data of the User published by the User himself according to his personal will, which are available to all Visitors of the Service, including those who are not registered. Acceptance of this Agreement will be a full and unconditional expression of the User's will for the public availability of the specified data, after which the Service has the right to process such data in accordance with applicable law for the purposes of fulfilling this Agreement.

1.16. Personal data — personal data of the User that is accessible only to the Administration of the Service and is not accessible to its Visitors. Personal personal data are: the User's e-mail address, his contact phone number.

1.17. Account — login and password that are created automatically and can be changed later by the User independently, which are used by him in the future to log into his Account on the Service. An account can be created by logging in to a User through their current social media account.

1.18. Other terms not defined in this section may be used in this Agreement. The interpretation of such terms will be carried out in accordance with the meaning of the Contract, as well as the current legislation. In the absence of an unambiguous interpretation of the term in the text of the Contract and in regulatory legal acts, the Parties will be guided by the interpretation of the term that has developed on the Internet and in business practice.

2. The subject of the Agreement. The order of the Course


2.1. The subject of this Agreement is the distance learning of Users in the Project on a Paid or Free basis, including, but not limited to, the provision of access to the Course as defined in paragraph 1.3. of this Agreement, upon receipt of which, the User learns for the first time and/or supplements THEIR previously acquired knowledge in the field of artistic creativity, including in particular, through the acquisition of practical experience and skills in the technique of drawing.

2.2. The Service offers any User the opportunity to choose one or more Courses in accordance with the declared subject of the Course and the requirements for its access.

2.3. Before viewing the Course, the User always has access to information about the Course of the following content:

- information about the Course content;
- the duration of the Course or the period of access to it. The User agrees that the start date of the Course can be changed to a later date, in which case the end date of the Course will be increased in proportion to the actual number of days of postponement of the start date. These changes in deadlines are related to force majeure circumstances, i.e. unforeseen circumstances that the Service Administration cannot foresee or prevent, including, but not limited to, the Teacher's illness, the Teacher's business trip, his unforeseen family circumstances, technical problems of the site.
- a list of tools and materials that the User will need to purchase independently in order to gain practical skills in the field of drawing (pencils, brushes, crayons, paper, palette, paints, etc.).

2.4. Access to the Course is provided by sending an active hyperlink to the User, which is sent to his email address specified during registration.

2.4.1. Access to the Courses posted on the Service's website, without specifying specific time limits, is provided for up to 01 (one) year, calculated from the date of its opening. At the same time, the Service Administration has the right, at the request of the User, and if technically possible, to resume providing the latter with access to the Service and the previously selected Course.

2.5. The User agrees that his Works, as defined in the section "Terms and Definitions" of this Agreement, can be checked by the Teacher during the Course only if such verification is provided by the Course itself. If the information about the Course does not contain information about the verification of Works, the User has the right to clarify this information by contacting the Administration of the Service. Verification of Works is a right, but not an obligation of the Service.

2.6. In case of full or partial cancellation of the Course paid by the User, at the initiative of the Service Administration, the User has the right to request a refund in proportion to the access actually used to Audiovisual Works within the Course, or, instead of a refund, use the Promo Code provided by the Service. At the same time, the choice of the Course topic by Promo Code remains with the Service Administration.

2.6.1. The refund of funds previously paid by the User, in accordance with the conditions set forth in this Agreement, is made in the same way as their payment.

2.7. The User is granted the right to complete all training on the Course at the very beginning of its implementation, in the middle or closer to the end. At the same time, the start date of the Course and the end date are not subject to change, except for changes as a result of unforeseen circumstances (force majeure), as defined in paragraph 2.3. of this Agreement. After the end of the Course, access to it is terminated, Materials and Works provided by the User are not returned to him, unless otherwise stipulated in the terms of the Course.


3. Payment for the services of the Service and their cost


3.1. The services are subject to payment through payment systems, information about which is available to the User on the Service.

3.2. After choosing a paid Course, a payment invoice is generated in the User's Account, which is duplicated to his email address. In the absence of payment, the Invoice is considered invalid.

3.3 FUNDS TRANSFERRED TO THE SERVER AS PAYMENT FOR THE COURSE ARE NON-REFUNDABLE.

3.7. In all financial matters, interaction with the Administration of the Service is carried out by e-mail address MARIINSKAYASCHOOL@GMAIL.COM


4. Personal data


4.1. Public and personal data specified by the User on the Service, the processing of which is carried out by the Service Administration, are used and processed to fulfill the Service's obligations to registered Users in terms of providing them with access to the Service and all its paid and free options.

4.2. The Administration of the Service does not provide Personal personal data of Users to third parties, except in cases when the User has consented to the provision of such data, or when the provision of such data is carried out at the legitimate request of authorized authorities.

4.3. The User has the right to delete his Personal Data by deleting his Account, as well as to delete part of the personal data in the Account without deleting the Account itself.

4.4. Personal Data is stored on the Service server. The storage period of Personal Data after the User deletes his Account is one year.

4.5. The Service Administration takes all necessary measures to protect Personal Personal Data from unauthorized access to them by third parties.


5. User Materials


5.1. All User Materials, as well as User Works, as defined in the "Terms and Definitions" section, which are posted by the User in his Account or transmitted to the Teacher by e-mail or through the feedback of the Service, are provided to the Service Administration on the terms of a simple non-exclusive license for the entire term of copyright protection without paying the User any remuneration from the moment such Materials are posted in the Account or from the moment they are received by the Teacher or from the moment they are sent via feedback.

5.2. The Service Administration has the right to use such Materials, including Works, in any way not prohibited by applicable law.

5.3. The User grants the Service Administration the right to use Materials and Works anonymously, that is, without specifying the name of their author.

5.4. The User gives his full and unconditional consent to the introduction of changes, abbreviations and additions to his Materials and Works, the supply of Materials and Works when using them with illustrations, preface, afterword, comments or any explanations, and such use of Materials and Works will not be considered a violation of copyright for the inviolability of the work. The granting of a license in accordance with this Agreement does not terminate the User's right to use his Materials and Works in any way at his own will. The exclusive right to such Materials and Works, as well as personal non-property rights belong to the User (author).


6. Feedback system


6.1. During the entire period of access to the Course paid by the User, the User is provided with the opportunity to communicate with the Course Teacher through the feedback system of the Service. The specified service is available only to Users who have logged in to the Service.

6.2. The teacher reserves the right to leave a message unanswered if:

- The Teacher believes that the question was asked by the User not on the topic of the Course;
- The message does not contain the attachment that the User is referring to;
- The message contains profanity or other offensive sentences;
- The message does not contain a question or its text accurately determines that there is no need to answer the message.

6.3. Any illegal communication of the User on the Service, regardless of whether it was directed to the Teacher or other Users or the Administration of the Service, gives the Administration of the Service the right to block the User's Account and apply other liability measures in accordance with the current legislation. Under unlawful communication in the context of this section, the Parties agreed to consider any insults, threats, bullying, slander and the like as an expression of the User's attitude towards other users of the Service, the Teacher and his Administration. Blocking the User's Account for the specified reasons gives the Service Administration the right not to return the funds paid by the violator for training on the Service.


7. User Reward System


7.1. After the end of the Course, the User can receive a Diploma, i.e. the corresponding personal document issued by the Administration of the Service in confirmation of the Course.


8. Final provisions


8.1. This Agreement is valid indefinitely.

8.2. All disputes and disagreements under this Agreement are resolved through the exchange of electronic messages between the User and the Service.

8.3. The Service is not responsible for failures that occur in telecommunications and energy networks; actions of malicious programs that have caused the termination or suspension of the Internet both in general and in individual network segments involved in the execution of this Agreement, for illegal actions of third parties aimed at unauthorized access and (or) withdrawal from building a service.

8.4. This Agreement may be amended at any time, in connection with which the User is obliged to check the relevance of the text of this Agreement on a weekly basis and carefully read all changes published by the Administration of the Service. The administration of the Service will take all necessary measures to notify Users in advance of changes to the text of this Agreement, in particular, by sending informational messages to the email addresses specified during registration. Nevertheless, the User's obligation to regularly review this Agreement is a priority, and the User cannot make claims to the Service Administration about his disagreement with the changes on the grounds of not receiving the relevant notification.
